As most people in Nigeria, the police PRO of Edo State obviously does not understand that there is no such crime as “homosexuality” in Nigerian law. The offence as described by the Criminal Code is the “act of engaging in a sexual act against the order of nature”. Homosexuality is not a sex act. There is a substantial distinction between a sex act and a sexual orientation. Homosexuality is not an act.
